on double cream bobbin humbuckers, then why are all the new BC Rich Classic series humbuckers exposed double creams? How'd they get away with that?

IDK why but dont you think that it would look more classy and classic if they had nickel covered humbuckers? I think that they would! :32:

this might be just me speaking out of my ass, but i thought dimarzio never got the trademark. ive heard its been in court like a million bojillion times but always got thrown out and theres another reason SD doesnt do the double cream.

No they do have the trademark, when I ordered my dbl creme duncans I had to have them covered.

I bet the pup have a different appearance (like Carvin), or they are paying a licensing, or royalty fee.

Here's another wild-a$$ shot-in-the-dark . . . maybe the trademark only applies to aftermarket pickups - not to a complete assembly, like a guitar.

Just a thought.

I always thought those had dimarzios in them because of the double cream... guess not.

Could be... I have seen a lot of guitars with double-cream bobbins and the pickups weren't DiMarzios...

DiMarzio owns the trademark for exposed coil, double-cream humbuckers. I'm not going to go into the ethics of how they got it, or what happened when Seymour Duncan tried to license it from them -- but suffice to say, they own it. For after-market and OEM.

I believe that Carvin can use it for two reasons: their use pre-dates DiMarzio and the 22 pole pieces avoid confusion. As for other companies who use it: I don't know. Either they could be paying DiMarzio a license fee. Or DiMarzio is supplying the pickups. Or maybe they're just plain infringing on DiMarzio's trademark and DiMarzio doesn't know about it.

Bottom line -- they own it.

I know that in the original BC Rich guitars that the pickups usually WERE Dimarzios. Maybe they still are? Lew

What if Duncan produces Humbucker with white bobbins, which age after a short time and turn into double-cream bobbins.???

I should have added that the bobbins of the BC Rich humbuckers had the BC Rich script logo on them. No where, not even on the base plate, do the pickups mention dimarzio. The BC Rich website calls the picksups "BSDM" which I am fairly certain are BC Rich design.

GG88: Nickel covers probably would look good on the classics, but the double blacks look pretty sweet as well.

I thought that they would just because of the nickel hardware.....if nato is mahogany then ill be looking at those classic bc riches!!! :32:

What they need to do is trademark double black, double white and all zebra colored bobbins as well as insulated wire and magnets with nickel or ceramic in them. DM can go on making their double cream pups, they'll just sound horrible. They'd eventually relent and let SD and others use their double cream.

trademark alnico 2,4,5 :)

or sell them shrinkwrapped and in white - the second they're exposed to oxygen, they turn cream :D

in fact, seymour should just copyright 'good tone' - no chance of confusion there :dance:

I'd love to hear how Larry D got that, since it was ALREADY in common use for, oh I dunno, 30 friggin' years. Was everyone else asleep at the wheel and never contested the application?

But anyway, maybe he feels it isn't worth it to go after Rich because since they're not aftermarket they don't impinge on "his" market. ...whutadork...

I talked about this with my girl friend who is a trademark laywer. She said that it is possible to file an opposition to invalidate the registered trademark if there is clear and convincing evidence which would prove the affidavit Dimarzio filed during the law suit against Seymour Duncan is false.

Then again Dimarzio would keep fighting in the court until the case reaches the Supreme Court and it would cost a lot of money to keep fighting with Dimarzio. Could be few million bucks just for the lawyer fee.

Anyone interested?

... and in the end the only people who gain are the greedy lawyers, not us tone-maniacs cos the cost of fighting the lawsuits gets passed onto us, the end-consumer.

Just the perspectives of an economist :)
