New EVH "Circles" guitar - double creme?

So EVH is releasing a replica of the "Circles" guitar Eddie used in the Unchained vid. You can read about it here, it's just a different paintjob compared to the other Frankenstrat models out. What's interesting is this:

Did DiMarzio lose the patent protection on the double creme pickups? Or is EVH headed towards a lawsuit? I doubt they would let them do this if they went to the trouble of patenting the idea so Duncan can't do it.

First it is a Trademark, not a patent.

Trademarks last, and Patents expire.

I have not read the legalese on the DiMarzio trademark, but a crafty lawyer could argue it applies to loose pickups, and not OEM on guitars.

Maybe Fender has Larry's OK, maybe they are paying him, maybe they are rolling the dice...

EVH seemed a little unhappy he couldn't take the DiMarzios with him when he left EBMM. Maybe this is DiMarzios way of making it up to him. Or EVH's way of thumbing his nose at DMZ. Or maybe EVH trademarked the guitar and that's a way around the DMZ thing. Or maybe the moon is made of cheese. Who knows?

their double cream trademark has to be the dumbest thing I've ever seen. Thats like Dodge getting the rights to make red cars or something like that

could be parchment if SD is making them.

if not, maybe DMZ is making them, in which case they could do double cream no prob.

Its not a dimarzio pickup, its a wolfgang humbucker just like the other guitars. I doubt they'd go with the dimarzio as the winder just so they could put it in this guitar

Is there any 'additional' profit from barring other people making a double creme? I don't think people choose color over tone or brand loyalty.

Fender wouldn't bother letting Larry wind them just so they can use the color. Its cheaper for them to do all the windings in house. I do think its a little lazy of them just to use the wolfgang pickups for everything. They should have had a pickup just for the stripped series, like they did for the art series in 2007 or whenever it was

Brian, DiMarzio trademarked (sorry I confused it with a patent earlier) double creme pickups so other makers are not legally allowed to manufacture them.

If these being parchment rather than creme saves them, why doesn't Duncan have parchment pickups available readily? I have only seen them as zebras. Such a petty distinction seems odd as well.

Maybe so but I hear that the Wolfgang pickup is an absolute beast in the striped series, and if they didn't sound good I don't think they'd ship them with the wolfgang pickups.

Exactly. And the opposite is true. I don't buy DMZ pickups for exactly that reason: their silly double-cream trademark.
 
I get the feeling that even if it truly is "double creme" Larry still can't do anything because they aren't selling them aftermarket, only OEM in these guitars. They aren't selling a pickup in a trademarked color, it's an instrument as a whole.

Looks like parchment to me.

The pickup is a beast too. I have one in my striped and one in my Les Paul. Killer in a Les Paul

I got an email from EVH yest advertising this guitar. I kinda dig it. love how it looks like a body laying and you twist the head for the vol control. haha. But yeah, am curious about the pup color too. Im guessing maybe there is a special agreement. maybe since its a slightly diff color or maybe cuz its EVH. Or maybe even cuz its not an aftermarket pup?? (yeah, I know they do sell them )

Ain't it just he owns the name "double cream"? I guess I can make my own pickups and call the color "rancid sour cream" and still look the same, right?.

They do...double white or parchment is available.

I think he means like NOT a shop floor custom. Like I have never gone into a shop or guitar center or anything and seen a double parchment bucker from Duncan on the shelf or behind the glass or whatever and I think that's what he means by "readily available".
