All the european manufacturers sell Double creams, be it Bareknuckle, Häussel, Rockinger, Schaller .... but I think that´s more of a calculated risk that Dimarzio won´t get the balls to try and litigate something that frivolous in Europe, especially against a company that hols a comparatively small portion of the market shared primarily by SD /Dimarzio /EMG more or less worldwide. ;)

i could however be completely wrong on this one, but seeing as that other trademarks like Coca Cola hold water and are honored it seems to be a logical assumption...

i think that's probably right, unfortunately.
it'd be good if there were a legal way around it, i'm sure SD could find several willing and able off-shore employees heh heh

Well this sucks! I unknowingly bought a new double creme SH-6 with a soldered cover VIA eBay over the summer. I then planned to buy a matching 59' neck.......I guess I dragged my feet a little too long on that custom order! Hmmmm......If only Dimarzio's sounded good.

I'm wondering if, in the interest of fostering competition, the Supreme Court could be persuaded to review the matter, and perhaps DiMzo would have to be more specific in their definition of the color - say, they have to pick the ONE color they claim from a Pantone wheel?

That leaves Duncan free to choose either color on either side of the one Dimmy picks, or maybe a darker "vintage-toned" color?

Especially if SD hits the Court with their chosen color scheme first.


I mean, a Free Enterprise system demands that all avenues of competition be opened - even those which can directly and negatively affect each competitor's profit - with the exception of name-branding (i.e. Duncan can't sell anything labeled DiMarzio, and vice-versa), but they are free to compete with color schemes (except where said color scheme is directly related to the branding i.e. the Ebay logo, as was featured in a court matter last year).

You cannot trademark or copyright anything that appears in nature - Hasbro owns the G.I. Joe body design only because the thumbnail is on the underside of the thumb, not the top. However, one would merely have to prove that the natural color of pickup bobbins is creamish, given the non-exclusive process used to make them.
If the color can only be achieved through the use of other elements/additives/colorizers, then Dimmy has the upper hand.

Funny thing is I've been an occasional Dimarzio user.
This one single issue with the double creme's has really turned me off on their pickups. In my world, business practices do matter.

Time to sell some Air Zones on the bay. I need more Duncans.

You cannot trademark or copyright anything that appears in nature.

What can be done is to settle a wavelength range as far as "cream" color is concerned. Since the colors we see are basically is characterized by their wavelength, a company can technically file for the "rights" to that wavelength and a given surrounding margin for pup bobbins. This is, of course, taking it to new heights of specifics, and it might in fact wind up costing not only DiMarzio but the other companies a lot of money to precisely measure the wavelength of the color of their bobbins!

Like I have said before, I am a big DiMarzio fan, but I do not agree with DiMarzio's "lock" on double cream bobbins. And I don't even like double cream bobbins, lol. But the fact of the matter is that it is rather sad and wrong that a color be patented; Ferrari might as well patent red! :banghead:

as for the whole thing, it's whack but they're smart for doing it. It's business and they're making $$$ and as long as they can get another stack of $$$ they're gonna strangle the consumer.

I've stopped buying dimarzio cuz all their pickups and adverts seem so gimicky, while only a few of their pickups sound good. They need to stop making products they think are what we want and focus on a few target applications and nail them.

Look what happened to american car companies when they had like 5 or 6 models that were just cute variations on the same platform.

It still does suck tho that if I want a white SG with white humbuckers I gotta freakin take splice some zebras. not cheap.
