Happy new guitar day?

Re: Happy new guitar day?

I was sent a wah pedal 2 or 3 years ago. I called MF and they told me to keep it. It was only $150 though so I don't know if because that item is more expensive they would want it back.

Re: Happy new guitar day?

1.) Karma may be rewarding me for all my good deeds.
2.) ****... I hope your wrong, dude.

1.) I take your point.
2.) Me too. I wouldn't like to guess as to what she would be up to with a stunt like that, and given the level of crazy she's displayed thus far, I don't want to guess either.

Re: Happy new guitar day?

One MUST do the "Right Thing" in these situations.

I'm not saying I condone thievery, because that is immoral and should be punished by the cutting off of a hand at the very least, but to be fair, "right" is almost always a matter of perspective.

Re: Happy new guitar day?

Keep it. And if it IS from a crazy ex then you can at least use it to smash her over the head should she return and attempt to burn down your house or overwrite your call of duty save game......

Re: Happy new guitar day?

Yes, you read that right. It was a question.

I got home from work a half ago and found this on my doorstep:
View attachment 53722

Its addressed to me so I open it up and find this
View attachment 53723
View attachment 53724

Its an LTD Ec-256. Great right? Except I didn't order one. I haven't order anything from musicians friend since I bought my JB about a week or two ago.

I checked my MF account and it's not in my purchase history. I checked my bank and there are no purchases pending or otherwise that I cant account for, nothing.

So, uh...which one of you guys works at MF and decided to gift me an axe?

Oh, the guitar itself is sweet. Plays nicely, good weigh, fast neck with wicked fret access, and coil tap.

I guess I'm a lucky guy. Unless its a well disguised bomb.

Actually, that's my guitar. I was wondering why it was taking so long to get here. I'll pm you my address.

Re: Happy new guitar day?

Is this a guitar you ever even looked at on their site?

Re: Happy new guitar day?

I don't think so. Never seriously at least.

So, that rules out a glitch linking your viewing history to the order system.

Is your address on the shipping label EXACTLY how you have it in MF's system?

Also, there might be reference numbers on the shipping label that may contain the order number. Maybe you could look it up that way on the site without alerting them. Might have purchaser info.

Re: Happy new guitar day?

I would not call this thievery. There was no deception on BF's part.

Consumer advice website 'What Consumer' says that Distance Selling Regulations state that "if you've been sent unsolicited goods, you are entitled to treat them as an unconditional gift and do with them as you choose. You are not required to keep them for any amount of time and you are certainly not required to pay for them. Any attempt to demand payment (by threatening means or otherwise) is unlawful."

Unsolicted goods - are yours to keep. This was put in place because various scammers were sending goods (of minimal or no value or just unneeded like photo copy paper), and then billing people and companies because they had 'accepted them' and therefore claimed they entered into some crazy over priced supply contract for many years sometimes.
So penalty is, they lose !

...and then there is this.

Seems like the guitar is legally and morally yours Happy New Guitar Day.

Re: Happy new guitar day?

...and then there is this. Dude that guitar is all yours congrats.

Unsolicited goods are those goods which are sent to someone without being asked those goods to be sent. Sending unsolicited goods in itself is not an offence. However, demanding payment for unsolicited goods is a criminal offence. Consumers can retain unsolicited goods or dispose them as they wish. They are under no obligation to keep them safe or to return them.

When unsolicited goods or services are provided to a person, the person has a right to accept the goods or services as a gift, and is not bound to return the goods or services. Goods or services are not considered to have been solicited unless the recipient specifically requested. Demanding payment for unsolicited goods constitutes an unfair or deceptive act or practice in trade or commerce for the purposes of applying Consumer Protection Act.

Yes. It was addressed to me with my correct info. I would never open anyone else's mail.

On the subject of a potential glitch: I always browse MF just to see what gear is out there so I'm sure I've glanced at the ESP/LTD offerings as I've always been interested in the brand.

Well, what I meant was is it exactly how you would enter it? For instance, people send stuff to me as Tom. However I always have stuff shipped to me as Thomas with my middle initial. Both would be mine but I would know if somebody else sent me something by that clue.

Any luck with the order number being a reference number on the shipping label?

It was exactly as I type it. I haven't checked the order number yet.

Re: Happy new guitar day?

I know a guy who bought a Hamer case. It came with a guitar in it. After two attempts at returning it and ordering another case, yep it came with a guitar in it, he sent the second one back, they told him to keep the first one. :11: :usa2: :butkick:

How do you stay in business like this? I get they write it off and there has to be an error factor with all the sales they do but wow huh?

When I posted Do the right thing before it was to spurn you on to choose your right thing not mine. That is why I did not say what the "Right Thing" is. Choose the one you want to own. :headbang:

Re: Happy new guitar day?

If it has your name and address on the box and with that law why wouldn't it be yours? Personally if it were me, I would return it if it doesn't have my name and address on the box although law allows me to own it. Not because I believe in karma, I don't. Just sometimes right/justice is more than rigid law. Happy NGD
