Just a thought. Could the picture be legally used because it is in the public domain?

I guess in the future start water marking them just to be on the safe side.... or take really horrible pictures.

I know Roman is a bit of a prick, but is he actually doing anything wrong by using the photo? (Legally I mean- if there's no copyright then he's allowed).

Also, compare "his" photos to BTMN's one and the quality is different. It sticks out like a sore thumb so I don't blame Roman for using a better photo which shows the guitar's true beauty.

He probably wishes ALL the guitars were taken by BTMN.

In the US, a person has a copyright on any media they produce, whether "officially" or not. Since BTMN took the picture, he then has copyright of the photo and Roman is using it illegally. Not the first illegal thing he's done.

No money in suing. Irritating and kinda cool to think someone thinks or wants to profit from my idea. I'm thinking about checking into if there is a Nevada consumer affair division or state attorney for false advertisement or bait and switch tactics and reporting him to the better business bureau in Vegas. :scratchch :approve:

Wow, I mean there is no point in suing, but still, I can't believe who would just throw that up there and be like "Hey, check out this guitar I built... or not really, but I could..."

I'm 99% sure he got that Keith Richards pic by way of Dave Rogers somehow. Last I saw it, the guitar was still hanging on the wall outside Dave's office in La Crosse, WI. It's possible that this is another KR Standard since the original was stolen. However the pic on Ed's site is typical of the photos regularly posted on the DGS website.

On a side note I wasn't terribly impressed with the way the guitar sounded. It may have been old strings and I did only get to play it for about 5 minutes, but that guitar sounded like crap.

Aren't you suppose to have your name on the photo for it to be protected? I see this all the time. I do not know the correct term, but it looks like a light inking.

the guy has some serious stones.. He does what he wants , seems to be loathed by the masses, but has prob made himself very wealthy...

does he have the means to custom build guitars?? Id go after him, just because . I guess you could also take it as a compliment

I'm sorry but this is just not correct.

Not only did he use a copyrighted picture without permission, he used it to advertise. There is big money in there and you can probably find a lawyer to represent you on a "if we win I get a share" basis.

My wife owns a photography studio and I'm doing some of the pre-lawyer legal legwork for her. Cases like this are common and almost always end with a couple thousand dollars changing hands outside of court.
