I think as long as their isn't a danger of losing money (not sure how it works in the US), then you should take him to court just for the principle, BTMN.

If there is a law about using other people's media- copyrighted or otherwise, then he is in the worng.

Like Aceman posted a win is tough cause not much damage. Principal wont matter. I am however thinking about Nevada Consumer Affairs route. I'm gonna talk to an attorney I know too but I'm leaning in the direction that there wont be much I can do. Especially since a friend has poked his nose in and now Ed has credited my friend as having made it. :eek5:

Ed Roman makes the worst "Fool" SG copy I've ever seen and to hear him talk about it he went through labors of love to get every color exact and blah blah blah, That copy he makes comes no where, and I mean NO WHERE close to the original, the colors aren't right, the angel looks ugly and he should be ashamed of himself posting pictures of celebrities using different Fool guitars and trying to pass them off as his copies. and if anyone tries to stop him from painting them, he starter in 1983 so he's grandfathered in......

No money in suing. Irritating and kinda cool to think someone thinks or wants to profit from my idea. I'm thinking about checking into if there is a Nevada consumer affair division or state attorney for false advertisement or bait and switch tactics and reporting him to the better business bureau in Vegas. :scratchch :approve:

I don't know who this Ed Roman guy is but I was just perusing his site and came across this guitar advertised as "James Hetfield Korina Explorer":

This guitar is actually a custom Ken Lawrence Explorer built for a guy who posts regularly on the ESP forums who has commissioned several guitars from KL. I've seen numerous photos of this guitar, along with several other close-up high rez photos of the guitar over there. Hetfield doesn't even have a Korina Explorer by Ken Lawrence. And none of Hetfield's KL guitars have that inlay.

Funny given the content of this thread, Ed Roman makes comments like this on his site:

"Just because some famous artist or their management decides to prostitute out their designs, or name, by saying they play a certain guitar, does not mean it's true. That looks like fraud to me !!!!! It confuses the buying public and therefore it is rightfully illegal. A lie is always still just a lie. When you lie to make money you are committing fraud and that is a crime punishable by time in jail. I'm not a lawyer, but I will be discussing this with my attorney at my next meeting with him."

"They wish they could sue me but they can't because the truth is and always has been my defense!!"

When I first heard about Ed Roman I was looking at his site pondering a guitar kit. But I don't buy from someone I don't know so I dug and he has alot of haters. The first place I did a truth be told type search was with the BBB and his report card is pretty bad. So I washed my hands of the idea and bought a cheap guitar and fixxed it up. Filing a lawsuit might cost you more in time spent in dealling with him, as he will want to get continuences and stuff like that, from the stories I've read he knows how to work the system to get you to just loose interest and go away. Plus the more you mess with a turd the better your chances are of getting crap on your hands.

One thing about Ed Roman that I do like and it is this:

Remember when the SRV Strats first came out? Of course you do. Okay, Fender claimed the SRV had an alder body. Ed Roman did not believe it. Because of the heavy dark spraying around the edges of the guitar, he cut into one revealing it had an alder veneer over poplar wood. FENDER WAS EXPOSED on his website!!! Fender later started using solid alder.

If I bought that guitar I would have been major pissed.

Ed Roman is probably the most disliked guy in the the guitar business. I have been on different forums and there was always Ed Roman bashing.

Ended up having to work today and could not but I do plan to call him and try to get my photo removed. Since initial note of this, I have found about 10 oither photos that belong to folks I know on various boards. :eek5:

Funny, you have big corporation suing private people for copyright infringements and winning - and here you have a (relatively small) corporation stealing intellectual property from private people...

I think you would have to prove that his using your photo caused you to lose money or income that would have otherwise ended up in your pocket. Did he take food out of your mouth or income that you would have made by using that photo? No? Then don't bother suing.

If someone published your work, even if you had no interest of making money from it, you can sue him. AFAIK.

We are all just speculating though. Aren't there any real blues LAWYERS on this forum?
