Of course the request is sound. Even I would soften up on them if they did.

If you want a certain pup in double creme but can't because of Dimarzio's trademark, you could alway use double creme pup stickers to put over any pickup you want.

Ummm, ahem, er......, welllllll- I bought a Seth set about 1 & 1/2 years ago and they both had nickle covers.

One day I decided to remove the covers.
The neck was Black/Creme and the bridge was Cream/Cream.

?
 
Just buy a used one. That way technically you're not actually giving your money to DiMarzio.

One day I decided to remove the covers.
The neck was Black/Creme and the bridge was Cream/Cream.

There is no trademark on black and cream. SD and anyone else call sell that all day long. The cream/cream came that way cause it was under a cover the trade mark is for 2 open coils in cream color with round pole pieces. Change the shape of the poles or hide them under a cover and you can use the color cream. Its been said that if you call the custom shop you can still get double cream by ordering it under a cover but ive also heard that you cant. I have not confirmed this myself so it is only a rumour.

That used to be the case, but no more. The word on the street was Larry used to look the other way when it came to Duncans, but no more.

And in related news, Zhangbucker just trademarked double-black, zebra and reverse zebra.

No, the problem is congress who (for the US) didn't clarify the scope of color trademarks.

By comparison it is clear than in Europe you can have color trademarks, but only on a whole "thing". It is clear over there that you cannot have a color trademark on a part - such as a pickup, only on a complete thing - such as a whole guitar.

It's not that in the US we specifically know one way or another. The law makers (that's congress, not a government agency) simply did not clarify. Normally that would mean you could challenge this in court, but at the situation in the US is ****ed up because of the flood of patent lawsuits. These existing lawsuits fought by very rich companies (usually software or industrial or pharmaceutical) have driven up the prices for lawyers specializing in intellectual property to a minimum of $600/hour (and that information is a couple years old). So guitar companies cannot afford to fight even if they would probably win.

Instead of *****ing about random government agencies trying to implement law as well as the law allows you will have to nudge your congress people.

I think it has to do more with what can be seen by other people...
They are more or less saying it is that color combination that makes people think of their company so they are saying that color combintaion is in essence a "trademark"...Stupid really.

As I said, you can get double creme stickers anyway if you want that type of look for your pups.

Im going to try to trademark the word Pickup. that way Ill rake in from both the guitar parts biz and auto companies.. Cha Ching!!

Yes, I know Black/Creme is not trademarked- I just included that because it was what I found when I undressed them (tee-hee-hee).

Oh, c'mon- they trademarked a thing in a certain color, not the color itself.

Color trademarks have been invented to prevent competitors to change their sales appearance deliberately so that people who want to buy product A buy product B by accident. That is why most color trademarks are concerned with cardboard boxes, namely the boxes you see on supermarket shelves and in other forms of retail.

That is another reason why this color trademark, on double cream humbuckers, stands very much on it's own. There is very little risk of mistaking a SD for a DiMarzio in Guitar Center even if they were both double cream since both of them come in retail packages that are not double cream colored, not to mention the packages are not on open shelves in the first place. And the majority of DMs pickups is not double cream, they are double black or zerba and others, none of them trademarked, so there's a very weak argument here of SD trying to sneak themselves in trying to pretend they are DiMarzio by offering double cream.

If somebody had the inventive and money to attack this trademark it would fall like a rock. It'll probably only take about a million bucks.

Yeah and it would only take you selling about 80000 cream pickups to recoup that cost. Considering that they sell about 1 cream for every 10 blacks this probably is not a sound investment. Much better things a company can do with a million bucks.
