A bit of a gripe.

Re: A bit of a gripe.

Now I'm not making a ton out of my playing ability but when branding ones self you have to look at potential endorsement materials. In this case MY pickup with it's name couldn't become a signature model because it's already taken. These are some of the things I contacted Cathy Duncan over. I figured it would be better to work something out sooner rather than pay lawyers to hash it out later.

It seems outside-of-likely that this pickup project will ever have commercial relevance to the extent that it's too much to ask of SD to not use the name. I think it makes more sense in this case to simply change what you call your pickup to make it more identified as your own, like "Cullenszoo's Hunter", for example. Since SD has the right to outright refuse your request that they not use the name, if it were me I'd not pursue it any further.

So your saying I should just give up because SD is a big company and don't care?

I think it's an imposition on Seymour Duncan that they couldn't name a new pickup model because someone out there, who doesn't even have a presence in the market place, just happens to be using that name for a project they're working on. So while they're not even obligated to honor your request, I don't think what you're asking of them is even reasonable in the first place. Again, it sounds like the case with the Magnetar was that DiMarzio might have got the impression is was something that Seymour Duncan was in the process of developing, and not merely someone's side project, truth not with standing.

Trying to avoid payback for the whole double cream debacle of ‘78

Re: A bit of a gripe.

There are a ton of silly dokken/Lynch songs you can name the pickup after. The wicked sensation, the gypsie’s cry, the hell child, the call of darkness.... just pick one

Re: A bit of a gripe.

If this isn't a pickup you're actively producing, marketing and selling in the marketplace.....I don't see where you have a claim honestly. If you want an exclusive claim on a product name, go through the legal process and get a trademark on it. I don't see this as the same situation as the one with Dimarzio.

Actually, the cases are pretty much the same except DiMarzio was cool about the situation.

Re: A bit of a gripe.

Case 1: Duncan Custom Shop makes a pickup for a customer who names it. There is known sold/custom built SD models out there that started like this. (To my knowledge).

Then DiMarzio makes a artist model pickup with a same name. Said artist learns about the other model, and asks DiMarzio to change the name.

Case 2: Person mods a pickup and names it. Then he learns a well known manufacturer is working to make a pickup with a same name.So he calls and questions about it.

It's not quite the same thing...

Re: A bit of a gripe.

The wildfires and mudslides (which both killed people btw) have been a doozy out here in California, specifically the Santa Barbara area. NAMM is approaching as well. It's kinda well known around here to avoid placing custom shop orders or asking questions since they'll be delayed.

Your name for a mod being honored is kind of a stretch without any legal protection. If it means that much to you, do something about it (trademark) rather than send emails and wait for a response.

So I found your blog https://www.reverbnation.com/page_o...dium=unknown&utm_source=page_object_news_item and your FB for music https://www.facebook.com/CullenTunes/

It appears that September 30, 2017 is the earliest date your pickup project first announced on any public forum. I'm willing to bet Seymour Duncan was well into the planning stages of "The Hunter" (which I've heard nothing about, tbf) by this time.
