GFS offers double-cream in their rail pups but they call it IVORY. Maybe that's the trick...

It´s a US trademark, valid only in the US. Foreigners have always been able to do as they please. Bareknuckle also makes double creams for example.

Problem is that most pickup manufacturers are US based ;)

Really? So Duncan could manufacture double cream Duncan-Designed pups as long as they're manufactured off-shore?

That's interesting. I always assumed that the relevant detail was where the pickup was sold, not where it was made.

On a similar note then, could SD, if they so choose, make double cream pickups as long as they only sold them in Europe and the rest of the world?

No, because Duncan is still a US based company. They can legally manufacture them now, they just can´t legally sell them.

Yes, but only if the sale is made in said foreign country. That´s why you can´t buy all those gibson knockoffs everyone raves about anywhere but over the internet. ;)

OR someone like GFS could simply pay licensing fees, something that is easily imaginable when one considers how much it costs to produce a Pickup in China. ;)

I think that escapes anyway because it's a rail, just as Carvin can make 22 pole double cream pickups which no-one will confuse with DM's 12 poles.

But yeah how different does the colour have to be before it's no longer infringing the trademark?

I believe the trademark does indeed only apply to regular polepiece pickups.

Even if you write to'em... what are wanna say? Give up your trademark so I can buy Duncans? Somehow I don't think is going to work... :naughty:

For example:

"Dear Larry Dimarzio,

I request that you give up your double cream trademark. As a consumer, it doesn't make any sense to me that this kind of trademark can exist and the whole thing makes me unwilling to use your products. If you give up the trademark, it will be an exceptional symbol of GOOD business practice that will make me consider your products again."

The trademark does not apply to rail or poles more than 6 (eg Carvin), and it applies to pups sold in the US, regardless of where they are manufactured.

The is why ESP can sell Edwards guitars with Gibson's open book headstock, but not in the US.

I have a pair of vintage Matsumoku MMK-53 humbuckers from the 80s. They came out of an old Aria guitar. To me they look and sound like those old DiMarzio SDs...but they are black...

Specs:

Kudos for standing your ground, shame on those that refer to you as stupid for doing so. I don't like paying for the reception of commercial television. If everyone followed suit and boycotted, cable & Satellite companies would crumble and networks would have to figure out how to get the multi millions of dollars worth of advertising into your home without cost to you. Back to pickups....there are no tone controls built into those pickups. They are made of a particular magnet material and a certain number of windings of a given gauge wire. These things in place there is a measurable electrical output of that pickup. This may lead for whatever purpose to a certain tonal characteristic that I don't see as being able to be preconceived or controllable, just occurs with a particular output and possibly magnet material. I believe many other aspects come into play for tone such as wood and especially amplification. My recommendation is to choose a pickup with the same magnet material and equal or greater output as the Dimarzio. You will discover much with your experimentation. Be careful or you may come across something that makes you never look back at Dimarzio. If you've never researched Bartolini you may do yourself a favor. Good luck.

I won't buy dimarzio anymore either, but thats for whole other reason but yeah i also started to turn whe i found out about the whole double creme BS!, copyright laws be dammed. really unless you actually created a certain thing you shouldn't be able to lock it down.

Whatever dimarzio can keep his 50 steve vai models and 50 john petrucci pup's.

do they have some good stuff yeah, but i can get a Sd custom shop whenever i can afford them, the other guy well unless your his buddy or sling his brand you're getting bone stock.

thats my morning over dose coffee rant!
