Really depends on whether or not you can deal with it. A little sanding to clean up the bevel would make that cut out look a little more intentional. It was definitely a DIY job to a normal pickguard, not a pickguard that was designed with that feature in mind, so the seller should have disclosed it either way. Also, not everyone wants or can even use a heel-adjusting truss cut-out on their pickguard. So, again, it's up to you...
If you can deal with it and the seller truly didn't make mention of it, then the seller should at least refund you a couple bucks for the trouble.
If you can't deal with it and the seller really didn't say anything about it, then you have the right to ask for a refund and at least a splitting of return shipping, in my opinion.
All in all, it doesn't sound like the seller is intentionally trying to screw anyone over here and I'm sure he'll work with you, whatever decision you make.
Of course, you could always keep that one as a spare, pay another $7.50 and get a brand new one:
