I agree. tuning stability and intonation issues are a problem and have to be fixed. but, it's nearly impossible for them to accept the pics as proof since you tinkered with the guitar. That's all I'm saying. They may be lenient but I'd suggest to cut your 'losses' and do what I told you.
1. measure the scale.
2. if necessary, plug the holes.
3. glue a small wooden block at the end of the cavity of the neck
4: attach the neck with a clamp, line it up, drill the holes and screw it back on.
Also, why did you need a shim? You've got a swimming pool rout below the trem's fine tuners. If you didn't have a shim, you wouldn't be able to pull up as much as with a shim,but the action wouldn't be impaired, that much. Since you can simply lower or raise the entire bridge by adjusting the screws.
This whole thing smells like yesterday's diapers and I'm not sure where the stench is coming from. The neck joint stability problem can be fixed with relative ease.
