Interesting. Certainly possible as it sounds on brand for Gibson showing a Texas judgment to a hosting service for a punitive effect and usurping engaging the traditional approaches.

BUT -playing up some of this would be a great promotional strategy as well so I would probably bet on some hyperbole or more to the story as well..

Although..... Gibson gonna Gibson.
 
Can't feel bad. We all know Gibson is litigious and on a tear of late. If you are still making Gibson-style guitars, well shame on you if you get dinged. There are so many other guitars shapes a builder could be building. I am not saying Gibson is right or wrong, but those builders making Gibson-shaped guitars should not be surprised when there is a knock on the door.

Yeah looking at the catalog it seems like this company exist purely because guitar company's have never really enforced their trademarks.
 
are these little companys eating into big bad gibsons market share that much? if so, maybe gibson should get their shit together and make a better product for a more reasonable price and push them out of the market the old fashioned way. if they stopped spending such ridiculous amounts of money on lawyers and lifestyle brand bullshit, they could probably do it pretty easily
 
If you bother to read through the entire article, you'll find his customers alerted him.

I didnt read it that way -as far as tying back to Gibson itself in that response

I think the way it's written he means that a customer notified him his portal/site was down, and the hosting service lawyer contacted him about the shut down, but it doesnt really mention the Gibson part, he could be meaning that he was notified that they pulled his stuff down for legal reasons and not elaborate at all unless Jericho filed procedural stuff...

Also how does he know the lawyer works in a cubical....:32:

There are usually two sides to these stories. We unfortunately do not have a legal or Patent system that is designed to handle it appropriately.

This is one of the only countries in the world where you can patent/trademark a color or a shape. Patently (pun intended) ridiculous. Unless you can prove that shape or color is functionally useful, then too bad. NOBODY is confused that a Dean Flying V for $499 is a Gibson Flying V for $1499. Make your guitars better, cheaper, cooler or perish.

Gibson is just a crappy company - bottom line. If they spent the time & money the blow on lawyers and useless BS that leads to more dislike than new customers, THAT would be doing something.
 
Man, just snagged a sweet New Lawsuit Era Jericho Explorer for only $2875!!! There was a while where you couldn't even find these babies at all. Felt like a solid week at least. This thing sings like butter. One of the best Snakebyte-style guitars I've played. Upgraded with a genuine bridge and knobs! Comes with strings. Priced to sell at $3000. Don't pass this up, it's one of the good ones.

The thing is if you do not enforce a trademark you lose it. So Gibson has to go after these companies or someone to have legal proof they enforce their patents and trademarks.

That's why the Tele and Strat bodies are copied so much. At the time they were released they were such an out there design Fender didn't need to enforce their ownership of the design so then it became generic
 
In the end, who has the money for the best lawyers? Who is willing to fight here? In the end, it might not matter who is 'right'.
